This Privacy Policy (hereinafter, the “Policy”) covers any information about users of our products and services (hereinafter, “You”) that may include personal data as defined by applicable laws and regulations (hereinafter, “Personal information”), which Clear Mind America Inc. and (or) its affiliated entities, including all entities belonging to the same group as Yzzy (jointly referred to as “Yzzy”), may obtain when you use any of the Yzzy mobile application, programs, products or services, including its search, e-mail, map, storage service or any other program, product or service (jointly referred to as, the “Services”), information about which you can find on yzzy.club and other Yzzy websites (collectively, the “Sites” or “Yzzy”), and as well as during the performance of any contract or agreement Yzzy concludes with you in relation to your using the Services. Also, Personal information can be obtained by Yzzy through its partners (“Partners”), such as advertising partners or payment providers, who provide you with access to or let you use websites, programs, products or services owned or operated by them, and from the sources of publicly available personal data. Partners can provide Personal information to Yzzy only as stipulated by applicable laws and regulations and in accordance with special agreements between Yzzy and each of the Partners. Please note that your using any of the Sites and/or Services may be subject to additional terms and conditions, which may amend and/or supplement this Policy and (or) include specific privacy terms in relevant parts of legal documents for such Sites and/or Services.

By using the Sites or otherwise indicating your acceptance (e.g. by clicking tick-box or bottom “agree” or continue”), you agree to the following terms of our Privacy Policy, which will bind you at all times and in whatever manner you use the Services.

To provide you with access to the Sites and Services, your Personal information is collected and used by Clear Mind America Inc., a company incorporated under U.S. law, with a head office registered at 1 Broadway, Unit 320, Menands, NY 12204, or its affiliates for particular Services or in specific jurisdictions. You can find information about the entity, which provides the particular Service in the relevant Service’s terms of use.
Privacy and security of your Personal information are extremely important to us. When you use the Sites and/or Services, Yzzy processes your Personal information and ensures its protection in strict compliance with applicable laws and regulations.
As part of our commitment to protecting your Personal information, we use this Policy to transparently inform you about the following:
(a) why and how your Personal information is collected and used (also, “processed”) by Yzzy when you access the Sites or Services;
(b) Yzzy’s role and responsibilities in this context as the legal entity deciding why and how your Personal information is processed;
(c) what instruments you may use to limit the amount of Personal information collected by Yzzy; and
(d) what your rights are in relation to the above processing.
Generally, “personal information”, “personal data” or similar terms refer to any information that identifies you or relates to you. However, the exact meaning of personal information may be determined by the law of the country of your residence.
Personal information collected when you use the Sites and/or Services, may differ depending on whether you access it while logged in to your Yzzy user account or without logging in. When you are logged in to your Yzzy user account as you are using the Sites or Services, Personal information collected by Yzzy may be collated and combined with other Personal information (such as your identity, contact details, age and gender, if you shared this information with us) collected by Yzzy in your user account. Yzzy does not verify Personal information provided by you unless otherwise provided in the Terms of Services of relevant Services, and does not decide the its credibility or whether you have the legal capacity required. However, Yzzy assumes that the information you provide is true, sufficiently complete and up-to-date.
We will process the following information which may be considered personal information:
Personal information collected by Yzzy when you access, interact with or operate the Sites and/or Services includes:

* It’s your choice whether to include sensitive information on your profile and to make that sensitive information public. Please do not post or add personal data to your profile that you would not want to be publicly available. If you choose to use Services and to share sensitive personal information on it (e.g., as part of your biography, in a message, or event invite), this will constitute your explicit consent to our processing that information. You will be free to edit or remove such information at any time if you no longer wish to share such information.
Additionally, we may collect publicly available usernames and profile information from third-party social media platforms, such as TikTok and Instagram, if you link your social media accounts with our Services or interact with our content on those platforms. This information may include your social media username, publicly available posts, engagement metrics, and other relevant data.

We may use the information we collect and publicly available information to help train our machine learning or artificial intelligence models for the purposes outlined in this policy. We may use the information we collect to pre-fill user profiles based on publicly available information from third-party social media platforms, to analyze social media data to assess user engagement, preferences, and potential participation in our Services and to conduct marketing activities, including targeted advertising, audience segmentation, and outreach based on social media interactions.
Where we rely on legitimate interests as the legal basis for processing personal data, we have considered whether or not those interests are overridden by the interests or fundamental rights or freedoms of the individuals whose data are being processed and concluded that the processing is, on balance, fair.
Where the legal basis is consent, you can withdraw consent at any time. You may withdraw your consent by adapting your settings or by deleting your content (for instance where you entered information in your profile that may be considered “special” or “sensitive”). In any case, you may withdraw your consent at any time by contacting us at the address provided at the end of this Privacy Policy.
We use your contact information to help others find your account if your settings permit.
Where the legal basis is legitimate interests, you have a right to object to our use of your data.
We will obtain your consent and provide you with an “opt-out” option where required by law.
We use information we collect to provide for the safety and security of our users, our products, services, and your account. This includes verifying your identity, authenticating your account, and defending against fraud, unauthorized use, and illegal activity. We also use the information to evaluate and affect the safety and quality of content on the Service - this includes investigating and enforcing our policies and terms, as well as applicable law.
To facilitate networking opportunities on the Services and to enable you to operate your account as a Creator and Participants; to provide offers and interact with our social media community and to help you connect with other users, recommend you to other users and recommend other users to you; show users’ profiles to one another, enable users to search for and connect with other users; and to make recommendations for personalized activities (including using generative AI tools)
To share information about you with our social media community, such as your username, story, image and other user information which is visible by all members of our social media community.
To send you promotional information through various marketing channels about our Services and to organize, review and optimize effectiveness of advertising campaigns on our Services and marketing our Services off our platform.
Some of our promotions are necessary for the performance of our contract with you. We will also use your information as is necessary for our legitimate interest in understanding your interests for direct marketing purposes from the information available to us, information observed or inferred and third-party information, in promoting our business and understanding campaign metrics.
We will obtain your consent and provide you with an “opt-out” option where required by law. For example, your consent will be required to process advertising ID.
We will use cookies and similar technologies if you provided your consent.
Necessary for our legitimate interest in the proper administration of our business, dispute resolution, ensuring technical operation of our Services and necessary for compliance with a legal obligation to which we are subject.
To engage our third-party service providers who may process your information on our behalf to facilitate the provision of our services and the fulfillment of essential service functions, such as web hosting, cloud storage, analytics, payments, plugins, communications, accounting, security and others.

To find and address ongoing, suspected or alleged violations of our Terms of Services, notably through the review of reports and interactions between users.

To retain data related to violations of our Terms of Use to address the violation and prevent against recurrences.

We will not receive or store any of your payment details, this is fully handled by the relevant payment service provider. If/when you make any purchases in the Service store, we are notified by the payment processor once the transaction takes place and then ensure you receive your purchase. We do not, however, receive any of your actual payment details or personal data related to the payment. We only keep the data concerning transaction dates, currencies, value, the last four digits of your card number and the subject of the transaction.

We will generally not share your information except with (i) our third party service providers and advisors who may process personal information on our behalf, (ii) our advertising, marketing and analytics partners, as explained above, (iii) our group companies for the purposes set out above, (iv) persons or authorities where we are compelled by law, (v) to the relevant entity in case of a merger, acquisition or collaboration, and (vi) other third parties where you have provided your consent.
We use suppliers to help us operate, distribute, market and improve our Services, such as data hosting and maintenance, analytics, customer care, marketing, advertising, payment processing and security operations. We also share information with suppliers who distribute and assist us in advertising our Services. For instance, we may share limited information on you in hashed, non-human readable form to advertising vendors.
We carry out due diligence on all Service Providers we engage to ensure they have adequate data protection and information security measures in place and only provide them with the personal data necessary to the service they are providing. Measures are taken to ensure that the data shared is non-attributable to the greatest extent possible and our suppliers are also subject to extensive obligations under our contractual arrangements, including strict data retention limits.
Sharing with other Users. You share information with other Users when you voluntarily disclose information on Service (including your public Profile data). Your profile is fully visible to all users and/or visitors of our Services, it can also be visible to others on or off of our Services (e.g., Visitors to our Services or users of third- party search engines). You may choose to share other user profiles and they may share yours with people outside of our Services, using the sharing functionality.
Creators. When you join the Activity or purchase tickets to, register for or donate to an Activity, including Paid Activity, or otherwise communicate with a Creator, or participate in or express interest in a Creator’s Activity, that Creator will receive the information you provide, including your Personal Data. We are not responsible for the actions of these Creators, with respect to your Personal Data.
SUGGESTED PERSONALIZED IDEAS FOR ACTIVITIES
We have a feature to suggest personalized ideas for activities based on your goals, interests, bio, occupation, professional area, gender, age, location (city or place), gender (“Input Data”). By using our Services, you acknowledge the processing of your data using generative AI tools for the purpose of personalized ideas for activities.
Opt-out
If you wish to opt-out of this feature you may remove suggestions in your profile.
For the convenience of our visitors and clients, Services may contain links to other sites, such as those of our partners or vendors, which are subject to different privacy policies. The Policy will not apply to your use of other websites. While we generally try to link only to sites that share similar high standards and respect for privacy, we have no responsibility or liability for the content, products or services offered, independent actions, or the privacy and security practices employed by these other independent sites. We encourage you to ask questions and review the applicable privacy policies found on such other websites, services and applications to understand how your information may be collected and used on these independent sites before disclosing information to third parties.
We will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy.
Account deletion
We delete most of your information after you delete your account, unless we are required to keep it for longer for limited legal purposes or for our legitimate interest purposes. It means that we will retain your Personal Data until you delete your account or request us to delete your data (by contacting us at support@yzzyapp.com). Once we have deleted your Personal Data, you will not be able to exercise the right to access, the right to erasure, the right to rectification or the right to data portability.
Please note that deletion of App does not imply the deletion of your account and your data
Photo verification data retention.
We retain the scans so that we can verify you in the future and to audit and manage our photo verification feature until we no longer need them for such purposes. After the applicable retention period expires, we take commercially reasonable steps to permanently and securely delete the scans from our systems. Photo verification data are only created and retained with your consent for the duration of the Photo Verification process. Photo Verification may take up to 24 hours. Once your Photo Verification is complete, the verification information is deleted. We retain screenshots from the photo selfie that you took for the purposes outlined above, but the Photo Verification information pulled from your photo is deleted.
You can request deletion of the scans by support@yzzyapp.com. In any event, this information is deleted upon account closure.
We delete your data and only keep limited information for specified purposes, as laid out below:
- to comply with applicable law (for instance, if you make purchases within the Services, some personal data may be kept for tax and accounting purposes);
- to evidence our compliance with applicable law (for example, if an account is blocked, we keep some account information and a record of the behavior that led to the block - this information is retained for evidential purposes in case of queries or legal claims concerning the block);
- for our legitimate business interests, such as fraud prevention and enhancing Users’ safety and security (for example, information may need to be kept to prevent a user who was banned for unsafe behavior or security incidents from opening a new account).
Usage data
We may retain usage data associated with the deleted account for the purposes of ensuring the security and integrity of our systems, supporting business analysis and improving our services. We will ensure that any usage data retained after account deletion is securely stored and used only for the aforementioned purposes.
Anonymized Data
Even if we delete some or all of your Personal Data, we may continue to retain and use anonymized data previously collected that can no longer be used for personal identification.
In most cases, Personal information is processed automatically without access to it by our staff. However, if such access is necessary, your Personal information can be accessed only by those Yzzy employees whose professional tasks require using this information. To protect your Personal information and ensure its confidentiality, these employees must comply with internal rules and follow protocols for processing Personal information. They are also required to follow all technical and organizational security measures protecting your Personal information.
Yzzy has also implemented adequate technical and organizational measures to protect Personal information against unauthorized, accidental or unlawful destruction, loss, alteration, misuse, disclosure or access and against all other unlawful forms of processing. These security measures have been implemented taking into account the state of the art of the technology, their cost of implementation, the risks presented by the processing and the nature of Personal information.
Some or all of your Personal Information that we collect may be stored or processed on servers located in the United States of America and in other areas outside your jurisdiction of residence, whose data protection laws may differ from the jurisdiction in which you live. As a result, this information may be subject to disclosure to governments, courts, or law enforcement agencies in those jurisdictions according to the laws in those jurisdictions and without notice to us or you. Subject to applicable laws in such other jurisdictions, we will use reasonable efforts to ensure that appropriate protections are in place to require the data processor in that jurisdiction to maintain protections of your Personal Information that are equivalent to those that apply in the jurisdictions in which you live.
We don’t address anyone under the age of 13 years. We do not knowingly collect personally identifiable information from anyone under the age of 13 years. If You are a parent or guardian and you are aware that Your child has provided Us with Personal Data, please contact us. If we become aware that we have collected Personal Data from anyone under the age of 13 years without verification of parental consent, we take steps to remove that information from our servers.
Promotional email messages from us – To opt-out of any future promotional email messages from us, you may use the unsubscribe button at the bottom of our promotional emails. You may also send an unsubscribe request to us at support@yzzyapp.com. Please note that if you opt-out of receiving promotional email messages from us, we may still send you important administrative messages relating to the Sites and/or Services.
Cookies – If you want to stop or restrict the placement of cookies or flush any cookies that may already be on your computer or device, please refer to and adjust your web browser preferences. Further information on cookies is available at www.allaboutcookies.org. By deleting cookies or disabling future cookies you may not be able to access certain areas or features of our Sites or some of its functionality may be affected.
Interest Based Advertising – As described above, we may, and may work with third parties, to use non-Personal Information to deliver targeted advertising to you based upon your online activities and other information. The online advertising industry provides a service through which you may opt-out of receiving events or creators you following and other advertising. Please note that by opting out, you will continue to see generic advertising that is not tailored to your specific interests and activities. Please also note that the opt-out from targeted advertising must be performed on each device and browser that you wish to have opted out.

This Policy may be subject to amendments. Yzzy shall be entitled to make such amendments at its own discretion, including, without limitation, to reflect changes in applicable legislation or amendments to the Sites and/or Services.
Yzzy undertakes not to introduce significant changes, imposing additional obligations or reducing your rights under this Policy without proper notice to you. You will be notified about such changes. If applicable, changes will be announced on the Site or Services (e.g. via a pop-up or web banner) prior to such changes taking effect, and you may also be notified via other channels (e.g. by email) if you have provided us with your contact details.
